Terms of Service

1. Acceptance of Terms

By accessing or using BidsFilter's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

BidsFilter provides a tender filtering and matching service for consulting firms. We scan publicly available tender notices from international development organizations and deliver curated reports based on your firm's profile.

3. User Obligations

You agree to:

  • Provide accurate and complete information when creating your profile
  • Use the service only for lawful business purposes
  • Not share your account credentials with unauthorized parties
  • Not attempt to reverse engineer, copy, or redistribute our service
  • Not use automated tools to access the service without our permission

4. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. Payment is due at the time of subscription. Fees are generally non-refundable except as required by applicable consumer protection laws or as expressly stated in these terms.

We may change our subscription fees at any time with 30 days' notice. Your continued use of the service after a price change constitutes acceptance of the new pricing.

5. Eligibility and Right to Refuse Service

BidsFilter is designed for legitimate consulting firms and professional services organisations. We reserve the right to refuse, suspend, or terminate service to any user or organisation at our sole discretion, including but not limited to cases where:

  • We reasonably believe the user is not a bona fide consulting firm or professional organisation
  • The information provided during registration is false, misleading, or incomplete
  • The user is attempting to abuse promotional offers, including creating multiple accounts
  • The user's intended use does not align with the service's purpose
  • We suspect fraudulent activity or misrepresentation

We may request additional information to verify your organisation's legitimacy, including but not limited to company registration documents, professional credentials, or references. Failure to provide requested verification may result in service refusal or termination.

6. Introductory and Promotional Offers

Introductory offers and any promotional pricing are intended for new customers evaluating BidsFilter for legitimate business purposes. These offers are:

  • Limited to one per organisation, including affiliates and related entities
  • Non-transferable and cannot be combined with other offers
  • Subject to verification of organisational eligibility
  • Revocable if we determine the offer is being abused or the user is ineligible

We reserve the right to charge the full subscription price or terminate service if we determine that an introductory or promotional offer has been obtained through misrepresentation or abuse.

7. Free Report

We offer a free first report with no obligation. No credit card is required for the free report. After receiving your free report, you may choose to subscribe or discontinue use. The free report offer is subject to the same eligibility requirements as our paid services.

8. Intellectual Property

The BidsFilter service, including our algorithms, reports, and website content, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our service without our express written permission.

9. Service Accuracy and Intended Use

BidsFilter is designed to help consulting firms discover relevant tender opportunities more efficiently. While we strive for comprehensive coverage and accurate matching, our service is intended as a discovery aid, not a replacement for your own due diligence or procurement research.

You acknowledge and agree that:

  • Our filtering algorithms may not identify every opportunity that could be relevant to your firm
  • Tender information is sourced from third-party platforms and may contain inaccuracies, omissions, or delays
  • Platform coverage, availability, and data quality may vary and change over time
  • Match scores and recommendations are based on the profile information you provide and our interpretation of tender requirements
  • BidsFilter should be used alongside, not instead of, your existing business development processes

We continuously work to improve our coverage and accuracy, and we welcome feedback on missed opportunities or matching issues. However, the nature of tender aggregation means no service can guarantee 100% coverage or accuracy.

10. Limitation of Liability

To the maximum extent permitted by law, BidsFilter and its operators shall not be liable for any missed business opportunities, including tenders that were not included in your reports or opportunities you did not pursue based on our matching scores.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, contracts, data, or business opportunities, arising from your use of or inability to use our service.

Our total liability for any claims arising from your use of BidsFilter shall not exceed the fees you have paid to us in the twelve (12) months preceding the claim.

11. Termination

You may cancel your subscription at any time. Upon cancellation, you will continue to have access until the end of your current billing period.

We reserve the right to suspend or terminate your account if you violate these terms or engage in fraudulent activity.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or through our service. Your continued use of the service after changes take effect constitutes acceptance of the new terms.

13. Consumer Rights

If you are a consumer, you may have rights under consumer protection laws in your jurisdiction that cannot be excluded or limited by contract. Nothing in these Terms of Service is intended to exclude, restrict, or modify rights that you may have under applicable consumer protection laws, including the Australian Consumer Law if you are an Australian consumer.

To the extent permitted by law, our liability for breach of any implied warranty or condition that cannot be excluded is limited, at our option, to the re-supply of the services or payment of the cost of having the services re-supplied.

14. Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia, for the resolution of any disputes arising from these terms or your use of our service.

This choice of governing law does not deprive you of any mandatory consumer protection rights in your country of residence that cannot be waived by agreement.
